U-Sportmoden GmbH & Co. KG, Maximilianstraße 23, 80539 Munich, (“Unuetzer”) operates the Web-site URL, including the relevant sub-pages (“Web pages”). Unuetzer attaches great importance to the confidential handling of your data. For this reason we only employ cutting-edge security systems for the protection of your data. We would like to explain below what we do to ensure the security of your data:

Responsible authority

The responsible authority in connection with data protection legislation is U-Sportmoden GmbH & Co. KG, Maximilianstraße 23, 80539 Munich, represented by Managing Director Fritz Unützer, registered with the District Court Munich dept. HRB (Trade register) Munich 74582, place of business Munich.

Use of your data

Unuetzer collects, stores or processes data only for the pursuance of the business purposes of Unuetzer. As a matter of principle, the Web pages are available for all users, with no collection of personal data. You do not need to register in order to benefit from the services of Unuetzer. Unuetzer requests your personal data only when you register for one of the services of the Web pages, in particular for the newsletter, or place orders via the Web pages. We use your data only for the purpose of allowing you have access to our services for which registration is mandatory or which are subject to a charge, or for the purpose of performing and invoicing services. Your personal data are therefore only requested, processed and used to the extent that is necessary for the purpose of the contract. In some cases, we work together with service-providers to whom we are contractually obliged to transfer certain data (name, address, etc.).

Collection of general information

When you visit our Web pages, information of a general nature is automatically collected. This information includes for instance, the type of Web browser, the operating system used, the domain names of your Internet service-provider and similar. In this connection, only information that does not allow your identification is involved. Moreover, such data is also generated when you visit any other Web pages on the Internet. As far as this is concerned, then, it is not a function specific to our Web pages alone. Information of this kind is gathered only in anonymity for our statistical evaluation.

Recorded data

Personal data such as name, address, contact details such as telephone number and e-mail address, and, where applicable, payment details, are recorded when you register to use the personalised services of Unuetzer, or when you place orders. Depending on the service concerned, additional data may be requested, such as company details, business address, business communications data, branch of industry, contract details and invoicing data. For chargeable services, we also record contract details and invoicing data. Moreover, you can submit additional details to us e.g. concerning your area of interest. 

In order that we may optimise our communications with you as a customer, and optimise our services, Unuetzer records and stores information created or submitted by you when registering, using the Web pages, or in communication with us, or which you impart to us by other means such as e-mail or telephone. This includes, where appropriate:

  • Your personal contact data such as name, e-mail address or telephone number
  • Details of your interests
  • Your date of birth
  • Details of information you wish to receive from us by e-mail, including the newsletter

We frequently receive acknowledgements of receipt and of reading in answer to our e-mails, if your e-mail program supports this function. If you categorically do not want to receive e-mails from us, you can notify us to this effect. We will then only contact you if we are obliged to do so by law.

Handling of your personal data

Your personal data are stored by Unuetzer on a specially protected server in Germany. We endeavour to have all necessary technical and organisational security measures in place to store your personal data so that it is protected against unauthorized access and misuse. These security measures necessitate that we occasionally ask you to furnish proof of your identity before we reveal data. Our employees are obliged to observe the provisions of the Telemedia Act (TMG) and Federal Data Protection Act (BDSG) when handling data. 

In order to protect security of your data during transference, we often use encryption processes (e.g. SSL). Our servers are protected with firewalls and anti-virus software. Backup and recovery, as well as task and authorisation concepts, are a matter of course as far as we are concerned.

At no time will Unuetzer disclose your personal data to third parties without your express permission, unless Unuetzer is obligated to do so by law.

Use of cookies and comparable techniques

Like many other Web sites, Unuetzer uses “cookies” and other comparable devices that transfer identification markings to your computer. 

By this means, Unuetzer automatically receives certain data concerning your computer and your Internet connection, such as IP address, browser used and operating system. In addition we record your visit history, i.e. the pages of our Web site you have visited, including sequence, date and time. During your visits, we use JavaScript to collect and evaluate additional data, including the time required to load a page, its complete or defective download, the duration of a visit to a detail page, interactive page data (e.g. scrolling, clicks, mouseovers), and information about leaving the page. 

With the aid of these devices, we can analyse how our Web pages are used, in order to optimise our overall presentation and design the content more individually for you, e.g. to recognise you as a return visitor to our Internet facilities. 

Furthermore, these methods avoid the need for you, as a user of personalised services, to keep registering every time. Under no circumstances, will personal data collected by us be disclosed to third parties, or a link to personal data be established without your permission. You can of course always view our Web pages without cookies. As a rule, Internet browser default settings accept cookies. If you so wish, you can deactivate cookies via your browser settings at any time. Please refer to the help function of your browser to ascertain how to change the default setting. Please note that it is possible that individual functions of our Web pages may not work if you have deactivated the use of cookies.

Third-party advertising on our Web pages

Our Internet presentation sometimes contains advertising by third parties and links to Web sites, for which Unuetzer is not responsible. We do not transmit your data to these third parties. Although Unuetzer passes no personal data whatsoever on to advertising businesses or their service-providers, they may assume that when you click on an advertisement, you agree with the criteria that apply to the Web pages.

Privacy policies of our partners

Individual content, information and services of the Web pages are provided by partners of Unuetzer or third parties. Unuetzer expressly points out that, as a rule, our partners have their own privacy policies, over which Unuetzer has no control. All liability and responsibility for the privacy policies of our partners are consequently excluded.

Duration of data storage

We adhere to the principles of data reduction and data economy. We therefore store your personal data only for as long as necessary to fulfil the herein-stated purposes or for as long as the manifold mandatory statutory storage periods require. After fulfilment of the applicable purpose, or the end of the mandatory period, the relevant data is routinely blocked or deleted in accordance with statutory regulations.

Entitlement to disclosure, correction, blocking, deletion and objection

You are entitled to request information on your personal data stored at Unuetzer at any time. At the same time, you may request correction or blocking of your personal data, or, with the exception of data subject to mandatory retention for business purposes, its deletion. Please contact our customer services for this purpose: by e-mail to or by surface mail to U-Sportmoden GmbH & Co. KG, Unützer Online, Maximilianstraße 23, 80539 Munich. In order that blocking can be taken into consideration at any time, the data need to be kept available in a blocking file for control purposes. You may also request that the data be deleted. 

You can change or revoke an authorisation or consent with an appropriate notification with effect for the future.

Amendment of our privacy policy

We reserve the right to amend this privacy policy as necessary in order to ensure its compliance with the statutory requirements in force at the time, or to implement changes to our obligations under the privacy policy e.g. regarding the introduction of new services. The new privacy policy then applies for your next visit. 

Insofar as you have registered with us for a personalised service, or used services in return for payment, you will be informed of such a change in text format, as a rule by e-mail at least thirty (30) days beforehand. In doing so, we will explain the substance of the change and the reason for it. If you do not object to the change within the period of notice, it will become effective. 

If you object to the change, the previous arrangement will apply for the time being. Either you or Unuetzer can then terminate the contract based on your registration, without notice. If you do not terminate the contract, or if delivery of the notification of the change could not be made, Unuetzer can completely or partially block your data until you acknowledge the new privacy policy and are able to declare your consent. Blocking can mean that you are only able to use our services in a limited form; in particular new services. Should there be no further contact, blocked data can be deleted by us after an appropriate period. 

Should the change be necessary in order to comply with mandatory statutory regulations, your data will always be blocked if you object to the change, or if delivery of the notification of the change could not be made. In this case, Unuetzer can delete the data immediately after blocking. Your entitlement to disclosure, correction, blocking, deletion and objection remains unaffected by such a change.
